Child support in Texas is determined by the non-custodial parent’s income and the number of children. For instance, if the non-custodial parent has one child, 20% of his or her net income would be deducted; 25% if there are two children; 30% if there are three children and so on. To ensure all child support payments are made, Texas law requires child support payments to be garnished from the non-custodial parent’s paycheck. Additionally, child support payments may be enforced by reporting the non-custodial parent to the credit bureau, having their license suspended, and being held in contempt.
Texas child support requires the non-custodial parent to provide medical coverage for the child. The non-custodial parent may achieve this by either purchasing a medical plan through their employment or reimbursing the custodial parent for placing the child under their employment coverage. Medical coverage is not calculated within the child support plan,it is an addition that must be provided by the non-custodial parent.
When a non-custodial parent refuses to pay child support, payment may be enforced by the following methods: (1) confiscating lottery winnings; (2) intercepting tax refund checks; (3) suspending any drivers, professional, hunting or fishing licenses; and/or (4) being held in contempt of court with the possibility of facing up to six months in prison.
