In Texas, the court may only divide and award the community estate.  The community estate includes all community property and debts.  All property and income acquired during the marriage is presumed to be community property.  Unlike community property, separate property is property owned by a spouse before the marriage and/or received during the marriage by way of inheritance or gift. In situations in which assets from a spouse’s separate property has been comingled with community funds—tracing may be necessary in order to recover it. If community funds are used to increase the value of separate property, the community estate may have a right to seek for reimbursement from the spouse who so benefited.
